АРХИТЕКТУРА ДОВЕРИЯ: ПЕРЕСБОРКА МЕДИАПРАВА В ЭПОХУ ФУНКЦИОНАЛЬНО МЕРТВОГО ИНТЕРНЕТА
Аннотация
Статья посвящена анализу структурной трансформации глобальной сети, характеризующейся переходом от пространства межличностной коммуникации к среде взаимодействия автономных алгоритмических агентов. В условиях прогнозируемого доминирования синтетического контента традиционные механизмы медиаправа, базирующиеся на реактивном регулировании и презумпции добросовестности участников информационного обмена, демонстрируют низкую эффективность. Исследуется проблема уязвимости когнитивных способностей субъектов права перед генеративными технологиями, что ведет к дисфункции институтов общественного доверия и невозможности верификации юридически значимых фактов.
Целью статьи является разработка концептуальной модели правового регулирования медиасферы, адаптированной к условиям высокой информационной энтропии и неотличимости синтетических объектов от аутентичных.
В работе использован междисциплинарный подход, объединяющий формально-юридический метод, экономический анализ права (в частности, доктрину «наименьших издержек предотвращения вреда») и технические стандарты информационной безопасности.
Обоснована необходимость смены парадигмы правового регулирования — перехода от реактивной модели к проактивной «архитектуре доверия». Предложена адаптация принципа «нулевого доверия» к нормам информационного права, включая введение опровержимой «презумпции синтетичности» для немаркированного контента. Сформулировано определение нового нематериального блага — «права на аутентичность», реализация которого возможна через инфраструктуру цифрового провенанса.
Автор пришел к заключению, что обеспечение стабильности гражданского оборота в цифровой среде требует смещения фокуса правовой охраны с содержания информации на историю ее происхождения, что должно быть подкреплено институтом строгой ответственности и обязательного страхования рисков для операторов систем генеративного ИИ.
