ТОКЕНИЗАЦИЯ КАК ИНСТРУМЕНТ ИНСТИТУЦИОНАЛЬНОГО ОБЕСПЕЧЕНИЯ АУТЕНТИЧНОСТИ ОБЪЕКТОВ КУЛЬТУРНОГО НАСЛЕДИЯ В ЦИФРОВУЮ ЭПОХУ

Аннотация
Анализируется возможность интеграции механизмов технологии токенизации в международно-правовой режим охраны культурного наследия. Автор рассматривает токенизацию не как коммерческую практику цифровых активов, а как способ неизменяемой фиксации цифровых моделей и истории изменений объектов культурного наследия. На основе анализа Конвенции об охране всемирного культурного и природного наследия 1972 г., Венецианской хартии 1964 г., Нарского документа об аутентичности 1994 г. и Хартии о сохранении цифрового наследия 2003 г. обосновано, что цифровая прослеживаемость может усилить процедурный аспект принципа аутентичности. Исследуются международные кейсы разрушения и реставрации объектов (Сирия, Мали, Франция), анализируются развитие цифровой документации и создание платформ цифровых клонов памятников. Методологическую основу исследования составляют формально-юридический метод, сравнительно-правовой анализ и телеологическое толкование международных нормативных актов. Селан вывод о необходимости разработки правовых инструментов рекомендательного характера под эгидой ЮНЕСКО для институционализации цифровой фиксации как элемента коллективной памяти человечества.
