The quarterly scientific journal “Works on Intellectual Property” is devoted to topical issues of copyright, related, cultural and information rights, legal regulation of cyberspace, legal support for the development of artificial intelligence technologies. publications recommended for the publication of the main research results for the degree of candidate and doctor of legal sciences and have the right to publish scientific articles in the following specialties: 12.00.01 - Theory and history of law and state; history of doctrines about law and state, 12.00.02 - Constitutional law; constitutional litigation; municipal law, 12.00.03 - Civil law; business law; family law; international private law, 12.00.04 - Financial law; tax law; budget law, 12.00.10 - International law; European Law, 12.00.11 - Judicial activity, prosecutor's activity, human rights, and law enforcement activity, 12.00.13 - Information law, 12.00.14 - Administrative law; administrative procedure, 12.00.15 - Civil procedure; arbitration process. The Agreement between the National Research University Higher School of Economics and UNESCO on the establishment of the UNESCO Chair in Copyright, Related information rights of 08/07/2020 (hereinafter - the Agreement of 08/07/2020) provides for the publication of a quarterly scientific journal "Works on Intellectual Property" (hereinafter - the journal, WIP). To implement the Agreement of 08/07/2020, it is assumed that the National Research University Higher School of Economics (hereinafter - NRU HSE) will join the founders of this journal with the assignment of the functions of the publisher to the Publishing House of the NRU HSE and the functions of the editorial office to the International Research and Education Center UNESCO on Copyright, Related, Cultural and Information Rights "NRU HSE (hereinafter referred to as the HSE UNESCO Chair).
History of WIP
The journal was founded in 1999 and has since been published by the staff of the HSE UNESCO Chair in Copyright and Other Intellectual Property Rights), which has been operating within the framework of the National Research University Higher School of Economics since 2009. The publication was initiated by such outstanding Russian legal scholars as I.L. Bachilo, M.M. Boguslavsky, V.A. Dozortsev, A.P. Sergeev, M.A. Fedotov, and their foreign colleagues Mihaly Ficsor (WIPO, CEECA, CITIP), Peter Maggs (Illinois University), etc. From the very first issues, the journal has established itself as an open dialogue space for an in-depth discussion of the most pressing problems in the field of intellectual property and information law. Thus, Volume I was compiled based on the international scientific and theoretical conference “Problems of Intellectual Property in the Civil Code of Russia” organized by the UNESCO Chair (26.03.1999), during which opposed views on the draft of the future Fourth Part of the Civil Code of the Russian Federation collided. Volume II turned out to be no less acute, the basis of which was formed by the discussions that unfolded at the scientific-theoretical conference "Actual problems of information law" (January 27, 2000), which was also organized by the UNESCO Chair. Many of the ideas published in those issues of the magazine remain innovative two decades later. In the first decade, the magazine was published 1 - 2 times a year. In 2013 - 2016 managed to ensure its quarterly release. In general, over two decades, 36 volumes of the journal have been published, containing 242 scientific articles, 206 of which are uploaded to the RSCI and are publicly available on the website of the ISEC “UNESCO Chair at the Higher School of Economics” on the corporate website (portal) of the Higher School of Economics (www.hse.ru / unesco /), and the rest are in the process of downloading.
Legal status of WIP
WIP journal registered as a periodical printed publication on May 28, 1999 (valid Registration Certificate - PI No. FS77-45963 dated July 15, 2011, ISSN 2225-3475). Since the UNESCO Chair is not a legal entity, the functions of the founder and publisher of the TIS were taken over by the autonomous non-profit organization "UNESCO Creative Center" (TTSU), created by prominent figures of Russian science and culture B.B. Okudzhava, M.A. Gluzsky, Yu.A. Ryzhov, and others, a member of the World Movement of UNESCO Clubs (Director General of TTSYU - I.V. Kirkora). Taking into account the Agreement of 08/07/2020, an agreement was reached with the leadership of the TCYU on the NRU HSE joining the co-founders of the journal. The work of compiling, reviewing, and editing the journal was always carried out by the staff of the UNESCO Chair at the HSE NRU free of charge, publishing and printing costs were covered by attracting sponsorship funds. (Russian Authors' Society, TVC Channel, TACIS Program on Intellectual Property, etc.), and in recent years - at the expense of the personal funds of the founders of TTSYU. The collection of fees from authors, as well as the payment of royalties, has never been practiced. TIS meets the requirements of the Higher Attestation Commission of the Ministry of Education and Science of Russia and has been included since 2014 in the List of peer-reviewed scientific publications recommended for publication of the main research results for scientific degrees of candidate and doctor of law. The journal is included in the Russian scientific citation system RSCI; over time, it is planned to include it in international scientometric databases. The mission of TISZhurnal today is a periodical printed publication of a scientific profile, publishing, based on the results of peer review, articles and scientific reports prepared by professors, teachers, graduate students, and research workers, and in some cases - by students of NRU HSE and other leading universities of the Russian Federation, as well as their colleagues from foreign universities and research organizations. Mission of WIP
Today, the journal is a periodical printed publication of a scientific profile, publishing articles and scientific reports based on the results of peer review, prepared by professors, teachers, postgraduate students and research associates, and in some cases - students of the National Research University Higher School of Economics and other leading universities of the Russian Federation, as well as their colleagues from foreign universities and research organizations. Among the regular authors of TIS are: Corresponding Member of the Russian Academy of Sciences Yu. M. Baturin, Doctors of Law, Professors I. A. Bliznets, R. A. Budnik, E. A. Voynikanis, I. E. Diskin, M. A. Krasnov, S. A. Kulikova (Saratov), T. G. Morshchakova, V. V. Orlova, S. V. Potapenko (Krasnodar), I. M. Rassolov, A. G. Richter (OSCE), S. G. Sergo, A. A. Streltsov, M. A. Fedotov, S. M. Shakhrai and others. At the same time, articles by employees of the International Scientific and Educational Center "UNESCO Department of the National Research University Higher School of Economics" traditionally make up no more than 10%, and by employees of the National Research University Higher School of Economics as a whole - do not exceed 25%.
The journal has published leading foreign experts in the field of intellectual property law and information law: Mihai Fichor (WIPO), André Lucas, Jean-Pierre Clavier, Elie-Pierre Rocchichioli, Paul Florencon (France), Michael Elst (Belgium), Michael Hill (Great Britain), etc. Professor Peter Maggs (USA) of the University of Illinois, a classic of German civil law Adolf Dietz from the Munich Max Planck Institute, as well as Angelika Nussberger and Antje Himmelreich from the Institute of Oriental Law in Cologne (FRG) collaborate with the journal on a permanent basis. The journal often publishes publications by legal scholars from the CIS countries, in particular, from Belarus, Tajikistan, and Kazakhstan.
Of particular value are publications that make it possible to include unique archival documents into scientific circulation, shedding light on the formation of Russian legislation in the field of intellectual property rights and information law. This is precisely the role played by the article by Corresponding Member of the Russian Academy of Sciences Yu. M. Baturin “The Phenomenon of Constitutionality: Legal and Moral Dimensions” (TIS, No. 1, 2013), which reproduced the full text of a historical, but never before published document – the Address of the President of the Russian Federation “On Constitutionality” of March 24, 1993.
The Uniqueness of WIP in the Magazine Market
There has been no specialized UNESCO publication in the field of intellectual property in the modern Russian-language scientific journal market for a decade and a half. The UNESCO Copyright Bulletin began to be published in the mid-1960s, first in English, French and Spanish, and later in Russian. It published problematic articles by eminent legal scholars from various countries, including Russia. The editor of the Russian-language version of the Bulletin has always been Professor E.P. Gavrilov, a member of the UNESCO Chair since its foundation in 1998 and to this day. However, since the mid-2000s, the publication of the Bulletin has ceased - first in print, and then in electronic form.
Among the specialized Russian periodicals, the following journals can be named: 1) "Patents and Licenses. Intellectual Property" (publishing group "Patents and Licenses"), 2) "Intellectual Property Law" (Publishing group "Lawyer" and ANO RNIIIS), 3) "IP Copyright and Related Rights" (founded in 1957 as "Problems of Invention"; Publishing House "Intellectual Property") and 4) "Copyright" (Bulletin of RGAIS and the Russian Authors' Society). Unlike TIS, all of the listed publications publish articles exclusively in Russian, and the circle of foreign authors is limited to the countries of the former Soviet Union.
On the contrary, WIP publishes articles not only in Russian, but also in English, which is provided for by the Certificate of Mass Media Registration (for example, the article by Aleksei G. Deineko “Anonymity as the inherent nature of Cyberspace”, published in volume XXXV for 2020; in volume XXXVII for 2021 there will be articles by Peter Maggs “False Information about Covid in American Social Networks" and Kaarle Nordenstreng, Svetlana Pasti “Defending normativity: Fundamental values should not be forgotten”). As for the publication in WIP of articles by authors from near and far abroad, this has been discussed above.
Relevance of WIP topics
Thematically, WIP covers the problems of not only traditional copyright institutions, related rights and other intellectual property rights, but also cultural and information rights of a person, legal aspects of the digital economy, artificial intelligence technologies, new media, synthetic types of creativity, transhumanism, biological and technological upgrade of a person, etc. Thanks to the journal, knowledge is transferred and accumulated, inter-university, including international cooperation in the relevant branches of legal science is ensured, the connection of research with legislative and law enforcement practice, with teaching and education is updated, which fully fits into the mission of the UNESCO Chair, as defined by the Agreement of 07.08.2020.
The long-term legislative, consulting and expert activities of the UNESCO Chair, conducting scientific research in the field of freedom of creativity and freedom of expression, information pluralism, legal and ethical aspects of the development of the information society, multilingualism in cyberspace, the transformation of digital inequality into digital integration, transhumanist technologies, the impact of artificial intelligence on legal institutions and social development - all this requires the stable functioning of an open discussion platform for the exchange of opinions, discussion of ideas, transfer and popularization of knowledge. An important aspect of the editorial policy of TIS is the initiation and publication of interdisciplinary studies covering the entire spectrum of scientific interests of the UNESCO Chair and extending to related areas of the knowledge economy, innovation, attention and impressions, philosophy, ethics and sociology of law.
Potential of WIP
Due to the extreme limited resources and lack of time to restore the stable operation of the journal at the proper level, the potential of WIP has not yet been fully realized. With minimal sufficient support from HSE, the journal will be able to become one of the centers of scientific communication of leading Russian and foreign legal scholars in the profile of the International Scientific and Educational Center "UNESCO Department of HSE" during 2021-2023, which will certainly stimulate the increase in the prestige and competitiveness of HSE in the global market of educational services and research and development. In general, the development of TIS is intended to promote Russian science and the system of higher professional education, increase their authority in the world academic communities, popularize the achievements of Russian scientists developing institutions of copyright, related, cultural and information rights.
Restructure of WIP
The concept of restructuring WIP in accordance with the requirements of the Agreement of 07.08.2020 provides, in particular, for ensuring stable quarterly publication, posting current and archived issues of the journal on the HSE portal in the OJS program, changing the format of the printed version of TIS from 60x90/16 to the traditional format for HSE journals 70x100/16, changing the graphic design of the cover and block with a corresponding improvement in design and printing performance, expanding the editorial portfolio by attracting new, most promising authors, including from among foreign specialists.
It is also planned to expand the structure of the journal. Thus, in addition to articles and scientific reports, it is planned to post information on scientific conferences and forums, upcoming and past dissertation defenses, as well as reviews of monographs and textbooks on the profile of the International Scientific and Educational Center "UNESCO Department of HSE". In addition, it is proposed to publish expert opinions prepared by the International Scientific and Educational Center "UNESCO Department of the National Research University Higher School of Economics" at the request of legislative and executive authorities, commercial and non-profit organizations, as well as the Constitutional Court of the Russian Federation, the Court for Intellectual Property Rights, and other courts. At the same time, TIS assumes the responsibility of informing readers about the further fate of these examinations.
Considering that the International Scientific and Educational Center "UNESCO Department of the National Research University Higher School of Economics" works not only at the Faculty of Law, but also at the Faculty of Communications, Media and Design, it is proposed to publish in WIP the most interesting decisions of the Public Collegium for Complaints about the Press - a unique body of professional and ethical media self-regulation and public co-regulation.
It is planned that each article published in the journal will be assigned a DOI, which should have a positive effect on the scientific citation index. The estimated need for DOI is about 60 units annually.
The restructuring of WIP should also affect the journal's distribution system. The subscription will be renewed (the subscription through the United Catalogue "Press of Russia" ended on 01.01.2020, but the subscription index 11287 was retained. If a positive decision is made, it will be possible to submit an application for the first half of 2022 in May-June 2021), including electronic, and sales of the magazine in BukVyshka will be established. Much attention will be paid to advertising the magazine through, first of all, the presentation of WIP at various events organised at the National Research University Higher School of Economics.
