PROBLEMS OF JUDICIAL PROTECTION OF COPYRIGHT AND RELATED RIGHTS AND JURISDICTION OF COURT CASES ON VIOLATION OF RIGHTS ON THE INTERNET
Abstract
As a rule, objects of copyright and related rights have external characteristics of the form that allow them to be uniquely identified and distinguish one type of result of intellectual activity from another. In some cases, the differences in the form of the external expression of the object consist in the details. Examples of such objects that are similar in form of expression are audiovisual works, video recordings, and recordings of TV programs. Despite the external similarity of the objects, the protection of rights to such objects, including in court, will be different. The article provides a comparative analysis of these objects. The author draws attention to the problems of protecting the rights to the objects under consideration in the conditions of a limited scope of international treaties in the field of related rights.
