Abstract
The author analyzes the current situation with the assessment of the protectability of the results of the functioning of artificial intelligence as a separate class of complex software products. It has been suggested that it is necessary to differentiate the algorithms underlying such software products, depending on the quality of the results of their functioning, into creative and non-creative ones. The thesis about the potential protectability as independent objects of the results of the functioning of creative algorithms is put forward. Considered and substantiated is the prospect of granting them protection as a new type of objects of neighboring rights.
