ARTICLE 1275 OF THE CIVIL CODE OF THE RUSSIAN FEDERATION: “DIGITAL HOPES” OF LIBRARIES AND LEGAL REALITY

Abstract

The possibilities for libraries to create digital copies of physical copies of works and documents in their collections are analyzed on the basis of Article 1275 of the Civil Code of the Russian Federation. At the time of the adoption of this article in its current edition, the library community expected that from now on libraries will receive broad powers to transition into operating in the digital environment. However, in practice, the rights of modern traditional libraries to provide their collections in the digital environment essentially did not expand with the adoption of the new edition of this article. The activities of the so-called digital libraries are still not subject to regulation by specialized norms of Russian law.
