IS IT NECESSARY TO TIGHTEN THE REQUIREMENTS FOR MANDATORY GENERAL MONITORING OF INFORMATION BY HOSTING PROVIDERS?

Abstract

The activity of hosting providers in providing their information technology resources for the purpose of storing information and providing access to it raises the issue of re- sponsibility for the dissemination of information of malicious content by third parties on the provider’s Internet platform. Currently, European researchers are discussing the need for mandatory use of the method of general content monitoring by hosting providers. In this connection, the provisions of the EU Directive “On Electronic Commerce” are being revised. The purpose of the article is to analyze Russian and foreign legislation, judicial practice determining the respon- sibility of hosting providers for information posted by third parties.
