DIGITAL RELATIONS AS A NEW PHENOMENON FOR THE REGULATORY SYSTEM

Abstract

The article is devoted to the study of the phenomenon of digitalization in the context of the development of legal regulation, as well as such category as digital legal relations. It is noted that the innovations of the legislation aimed at the legal formalization of the development of the digital economy in Russia form a system of a fundamentally new type of legal relations — digital legal relations.

Digital legal relations are considered as a separate phenomenon in the legal regulation system and as a possible basis for the formation of a new branch of law. Due to the lack of theoretical scientific research, it makes the assumption that it is premature to claim the emergence of a new branch of law.

The author analyzes the relationship between digital legal relations and legal relations regulated within the framework of information law. It was concluded that the key feature of the content of digital legal relations is the regulatory rules in the field of application of digital technologies. Information that has been processed using these technologies is considered as digital data and has an economic aspect.
