HISTORY AND DEFINITION OF THE CONCEPT OF RELATED (NEIGHBORING) RIGHTS

Abstract

The objectives of this study are to analyze the history of the development of related rights and formulate a definition of the concept of related rights. In the work, the author explores the origin and development of related rights at the international and domestic levels. The paper analyzes various approaches to the formulation of the definition of objects of related rights, describes the pros and cons of such approaches. The article consistently criticizes various approaches to the understanding of related rights, and also formulates the conclusion that, due to the legal nature of related rights, the definition of the concept can be built exclusively with reference to specific objects of related rights. The relevance of the topic is due to the novelty of the institute of related rights in the world and in domestic legislation, as well as the fact that in the legislation of various countries, objects of related rights are understood as different results of intellectual activity.
