PROTECTION OF COPYRIGHT ON ONLINE TRAINING MATERIALS

Abstract

Currently, the number of online courses is actively growing, but at the same time the number of violations of rights to this object of intellectual property is also increasing. And the protection of infringed rights is difficult, because, among other things, complicated by the development of technology and the Internet. Attempts to protect the right often do not pay either time or efforts of the author, and even not always leads to results.

The topic seems relevant in today's reality, in which the number of cases and opportunities for violation of authors' rights is increasing, the judicial practice is quite contradictory, the explanations of the higher courts, which could put a point on this issue, are absent.

The aim of this study is based on the analysis of factual material and law enforcement practice, critical reflection on the existing legislation in the field of copyright protection on the Internet and the Russian Federation and development on this basis of proposals to improve legislation in this area.

The author, having in mind both extrajudicial and judicial approaches to protecting copyright, analyzes the cases of violation of copyright to online training materials and methods of their protection. Ways to improve law are proposed, taking into account the socio-cultural characteristics of the development of society.
