COPYRIGHT PROTECTION: THE COSMOPOLITANISM OF RUSSIAN PRIVATE INTERNATIONAL LAW AGAINST THE BACKGROUND OF THE COLLAPSE OF INTERNATIONAL LAW

Abstract

The article analyzes the general legal message and specific features of the current system of conflict of laws and substantive regulation of relations on creation and use of copyrightable works in Russia. The mechanisms of both cosmopolitan and restrictive order enshrined and applica- ble in the Russian private international law will be consid- ered. On this basis, some predictions are made concerning copyright protection in the sphere of relations with a foreign element in the situation of curtailing international relations of the Russian Federation with European countries and insti- tutions. A special place is given to the role of the concept of human rights in preserving the protection of foreign authors’ rights even in the case of Russia’s withdrawal from certain international agreements.
