COPYRIGHT ISSUES IN THE PROCESSES OF DISTRIBUTION AND DISTRIBUTION OF A DOCUMENTARY FILMS IN KAZAKHSTAN

Abstract

The article examines the features of the documentary film from the point of view of copyright in the distribution and rental processes in Kazakhstan. Since there are difficulties in the processes of promoting a documentary film in the country, it is necessary to pay attention to the reasons for this situation of this form of audiovisual media product. Television does not fully reveal the essence of the documentary, negatively affecting not only the perception of documentaries by the audience, but also the perception of this form of work in the legal aspect. The belief that a documentary film only informs and does not have a clear authorship devalues and casts doubt on the possibility of considering a documentary film as an object of copyright. The author also draws attention to the transformation of the passive “hero” of documentaries into an active “social actor” who can potentially claim related rights along with the screenwriter and cameraman. The purpose of the study is to identify problematic issues and propose solutions in this aspect, taking into account the local legislation of the Republic of Kazakhstan. As a research method, the analysis of the legislative acts of the Republic of Kazakhstan concerning copyright in documentary films, as well as the analysis of the activities of documentary filmmakers of Kazakhstan, representing a new generation of documentaries in the digital environment — Kanat Beisekeyev and Rinat Balgabayev, was used. In conclusion, the author proposes to revise the legislation on copyright issues, taking into account the specifics of the documentary (related rights, music, protection from piracy). The author also notes the need to take into account the changes that the Internet space and social media bring with them in matters of copyright protection.
