DIGITALIZATION OF PUBLIC ADMINISTRATION: LEGAL FOUNDATIONS OF ESTABLISHMENT AND DEVELOPMENT
Abstract
Over the last decade, digitalization, spreading at lightning speed, has encompassed both the world in general and the Russian Federation in particular, and is transforming various aspects of human life. One of the main sectors of society, the public sector, is being seriously affected by the integration of digital tools, technologies, processes and solutions into the operations and services provided to the population. Changing the ways of interaction in the “state-society” system is aimed at improving the efficiency of public administration, involving the population in public decision-making, and reaching opinions on topical social issues. The paradox is that the digitalization of public administration generates numerous legal problems and consequences that need to be studied by both academics and the legislator himself.
The purpose of the article is to identify the peculiarities of the legal framework of the Russian Federation regulating the application of digital technologies in aspects of public administration: e-governance, digital public services, data protection. The article considers the process of implementation and influence of digitalization on the sphere of public policy. The classification of regulatory legal acts by categories of regulation of individual spheres of digitalization and informatization is proposed. The fundamental legislative documents of the Russian Federation are analyzed to identify their weaknesses. The article concludes that the rapid introduction of digital technologies by government structures in their arsenal does not guarantee the efficiency and security of governance. The existence of a clear legal framework for the protection of privacy, data security and citizens' rights is necessary for a simplified orientation of specialists in all spheres in the “landscape” of digital public administration
